Terms of Use

These Terms of Use (the “Terms”) are an agreement between you and Spin (“Spin,” “we,” “us,” or “our”). They govern your access to and use of the Spin iOS and iPadOS application, including its community, live-room, chat, and related services (together, the “Service”).

By downloading, accessing, or using the Service, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Service. If you use Spin on behalf of an organization, you confirm that you are authorized to accept these Terms for that organization.

You must be legally able to enter into these Terms. If you have not reached the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you and supervise your use.

Online community features, public content, and live rooms are intended only for users aged 13 or older. Users under 13 may use age-appropriate local features only with a parent or guardian’s permission and supervision. Do not misrepresent your age group or help someone bypass age-based protections.

Spin lets you create, edit, save, and spin configurable wheels; discover and remix eligible community wheels; and create or join public or private live rooms with shared spins, reactions, and text or emoji chat. Some features can work locally, while community and live-room features require internet access and an anonymous service account.

Wheel selections use randomized logic and are provided for entertainment and casual decision-making only. Outcomes are not guaranteed to be perfectly random or suitable for any particular purpose.

• Do not use Spin for medical, legal, financial, emergency, safety-critical, gambling, or other high-stakes decisions.
• You are responsible for reviewing wheel options and deciding whether an outcome is appropriate before acting on it.
• Internet access, device compatibility, and carrier charges are your responsibility.

Spin may create a device-scoped anonymous account for online features. Your profile may include a nickname, avatar, declared age group, language preference, and an internal identifier. You must provide accurate age-group information and keep your device reasonably secure.

You are responsible for activity performed through your profile or device. Tell us promptly if you believe your profile has been compromised. Resetting or deleting app data may remove local content and may make an anonymous account or its cloud content unavailable to you.

You retain any rights you have in content you create or submit, such as wheel titles, options, notes, profile details, chat messages, reactions, and reports (“User Content”). You are responsible for your User Content and must have the rights and permissions needed to submit it.

You give Spin a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, display, moderate, and distribute your User Content only as reasonably needed to operate, secure, improve, and promote the Service. For content you choose to publish publicly, this license allows other users to view, save, and remix it through Spin. This license ends when the content is deleted from our systems, except for reasonable backups, safety records, legal obligations, and copies created by other users before deletion.

Feedback and suggestions may be used without restriction or compensation, but we are not required to use them.

You must use Spin lawfully and respectfully. You may not submit content or use the Service in a way that harms people, the Service, or the rights of others.

• No harassment, bullying, threats, hate, exploitation, sexual content involving minors, graphic violence, or encouragement of self-harm.
• No illegal activity, scams, impersonation, spam, malware, unauthorized advertising, or attempts to exchange private contact details through restricted features.
• No infringement of copyright, trademark, privacy, publicity, or other rights.
• No attempts to bypass filters, rate limits, age protections, access controls, or security measures; disrupt rooms; scrape the Service; reverse engineer it where prohibited; or access another user’s data.
• Do not publish sensitive personal information about yourself or anyone else.

Spin may automatically filter or block content, links, contact information, or excessive activity. Users can report content and block other users. We may review reports and related evidence, restrict visibility, remove content, close rooms, limit features, suspend access, preserve evidence, or contact authorities when reasonably necessary.

Moderation tools are imperfect. We do not promise to review every item or prevent all objectionable content, and the presence of content does not mean Spin endorses it. If you encounter unsafe content, use the in-app report and block controls and stop participating in the room. For an immediate danger, contact local emergency services.

Use of the Service involves processing information needed to provide local and online features, maintain rooms, synchronize eligible wheels, enforce safety rules, handle reports, and support users. Live-room chat messages are designed to expire after a limited period, currently 24 hours, although report evidence, security logs, backups, and records required by law may be retained longer.

Do not assume that public wheels, live-room activity, nicknames, or messages are private. Other users may see, copy, or report content that you share with them. Your use of Apple services is also subject to Apple’s privacy practices.

The Service, including its software, design, branding, templates, graphics, sounds, and other materials provided by Spin, is owned by or licensed to Spin and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms and Apple’s applicable license terms, no rights are transferred to you.

You may not copy, sell, sublicense, distribute, or create derivative works from protected parts of the Service except as allowed by law, applicable open-source licenses, or written permission from Spin.

The Service is provided on an evolving basis. We may add, change, suspend, or discontinue features; limit usage; or require updates for security, legal, or operational reasons. Online services may be unavailable because of maintenance, network failures, third-party services, or events outside our control.

We do not guarantee that content, rooms, anonymous accounts, or settings will always be available, synchronized, or recoverable. Keep your own copy of content that matters to you.

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, or security. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

To the maximum extent permitted by law, Spin and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, opportunities, or business interruption, arising from your use of or inability to use the Service, user conduct, User Content, or reliance on a wheel result. Where liability cannot be excluded, it is limited to the greatest extent permitted by applicable law.

You agree to be responsible for claims, losses, and reasonable costs arising from your unlawful User Content, your violation of these Terms, or your infringement of another person’s rights, to the extent permitted by law.

You may stop using Spin at any time and use the in-app data deletion or reset controls that are available to you. We may suspend or terminate access, remove content, or close a room if you breach these Terms, create risk, or if continued operation is no longer practical or lawful.

Provisions that by their nature should continue—including ownership, licenses needed for retained safety or legal records, disclaimers, liability limits, and dispute provisions—survive termination.

These Terms and any additional terms presented within the Service form the agreement about your use of Spin. Applicable consumer-protection rules remain unaffected. Disputes are governed by the laws and courts that apply under mandatory law where you live, unless another valid agreement requires otherwise.

If one provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, merger, sale, or transfer of the Service.

We may update these Terms as the Service or law changes. We will update the effective date and provide additional notice when required. Continuing to use the Service after updated Terms take effect means you accept them. Contact us at support@spinparty.app with questions, complaints, or claims concerning Spin.
